On September 25, 2013, Jersey City passed Ordinance Number 13-097, requiring that all Jersey City businesses provide paid sick leave to employees with 10 or more employees. Businesses with less than ten employees must provide unpaid sick leave.

Under the Ordinance which takes effect on January 24, 2014, employers must provide two forms of notice to employees of their rights under the law.  Employers must provide individual written notice to each of their employees at the commencement of the employee’s employment or as soon as practicable if the employee is already employed.  In addition, employers must display a poster in a conspicuous place in the workplace containing notice of the Ordinance.

To satisfy the second form of notice under the Ordinance, Jersey City recently released frequently asked question posters available for employers to display.  One of the posters is for employers and the other poster is for employees.

To ensure compliance with the first notice requirement of the Ordinance, employers should consider adopting the Ordinance’s key provisions into their employee handbooks.
